• THE CITY OF ALAMEDA'S POSITION

The City maintains that legal action was necessary to enforce unmet lease obligations and ensure completion of the new 18-hole North Course, framing its actions as essential to protecting a municipal asset for the community.

It has pointed to what it perceives as an erosion of the course’s community feel and argues that Greenway lacked the experience and resources to fulfill its responsibilities, citing these concerns as justification for intervention.

Several City officials have claimed that they did everything they could to resolve differences and that legal action was a last resort.

  • GREENWAY GOLF'S POSITION

Greenway contends there was no legal basis for the City’s action and that its true objective was to confiscate the lease and establish preferential treatment for select groups.

The company points to sworn deposition testimony that it says shows high-ranking City officials knowingly made false claims about Greenway Golf, and argues that its significant capital investment, national recognition for the North Course, and unprecedented community programming directly contradict the City’s allegations.

In Greenway’s view, City officials made no effort at any informal resolution before escalating the disagreement to legal action at taxpayer expense.
